The designation of a car as “classic” for tax purposes varies by government entity. State governments, which handle property taxes and vehicle registrations, have criteria that differ from the Internal Revenue Service (IRS) standards for federal income tax. The tax benefits and responsibilities depend on which agency is levying the tax.
State laws provide the most common tax benefits for classic car owners through special vehicle classifications, often labeled “antique,” “historic,” or “classic.” These designations are granted by the state’s Department of Motor Vehicles (DMV). A common threshold for this status is the vehicle’s age, with many jurisdictions setting the mark at 25 years, though some states may require a car to be older or younger.
Achieving this classification can lead to financial advantages. Owners often benefit from a substantially reduced annual registration fee or a one-time permanent registration. For personal property tax purposes, a vehicle with an antique designation may be valued at a nominal, fixed amount, such as $500, regardless of its actual market value, leading to significant savings.
These benefits are accompanied by strict usage limitations. The vehicle must be maintained in a substantially original condition without significant modifications. States also impose annual mileage caps, often 2,500 to 5,000 miles, and prohibit the car’s use for regular commuting or commercial purposes.
The federal government’s view of a classic car is as an asset upon sale. The IRS categorizes a classic car as a “collectible” for income tax purposes. This classification becomes important when you sell the car for a profit.
When a collectible is sold, any profit is subject to a long-term capital gains tax. While most assets are taxed at preferential rates, collectibles are taxed at a higher maximum rate of 28% if held for more than one year. Depending on the seller’s income, a 3.8% Net Investment Income Tax (NIIT) may also apply to the profit.
To calculate the taxable gain, determine your cost basis, which is the original purchase price plus any capital improvements like an engine overhaul. The taxable gain is the sale price minus this cost basis. For example, if a car was purchased for $30,000 and sold for $50,000, the $20,000 gain would be taxed at the 28% rate, resulting in a $5,600 federal tax. If the car is sold at a loss, that loss is considered personal and is not deductible.
Before applying for a state-level classic or antique vehicle designation, an owner must gather several documents.
The completed application package can be submitted to the state’s DMV. Submission methods vary by state and may include mail, in-person delivery at a local office, or an online portal for electronic uploads and payments.
After submission, the DMV will review the documentation to verify the vehicle’s age, ownership, and that all requirements have been met. This processing can take anywhere from a few weeks to a couple of months.
Upon approval, the owner will receive new license plates designated for antique or historic vehicles. An updated registration certificate reflecting the new classification will also be issued and must be kept in the car.
