Overtime pay is mandated for all hours worked over 40 in a single workweek for non-exempt employees. While federal law sets this baseline, some states may have additional overtime rules, such as requiring overtime for hours worked beyond a daily limit or for work on the seventh consecutive day.

Determining the Overtime Rate

The standard method for calculating the overtime rate involves determining an employee’s “regular rate of pay.” This rate is generally the employee’s hourly wage, but it can also include other forms of compensation, such as non-discretionary bonuses or commissions, divided by the total hours worked in a workweek. The FLSA requires overtime compensation be paid at a rate of not less than one and one-half times this regular rate of pay, commonly referred to as the “time and a half” rule.

The overtime rate is the regular rate of pay multiplied by 1.5. For example, if an employee’s regular rate is $10 per hour, their overtime rate would be $15 per hour. The regular rate may not be lower than the federal minimum wage or, where applicable, a higher state or local minimum wage.

Calculating Overtime Pay for $20 an Hour

Another example involves an employee working 50 hours in a workweek at the same $20 hourly rate. Regular pay for 40 hours remains $800. Overtime hours total 10 (50 total hours – 40 regular hours). Multiplying these 10 overtime hours by the $30 overtime rate yields $300 (10 hours × $30/hour). The employee’s total weekly earnings would be $1,100 ($800 regular pay + $300 overtime pay).
