Form 8843, “Statement for Exempt Individuals and Individuals with a Medical Condition,” is an informational statement required by the Internal Revenue Service (IRS). Certain nonresident aliens, such as those in the U.S. on F, J, M, or Q visas, file it to document their presence for tax purposes. Filing this form establishes you as an “exempt individual,” meaning your days in the U.S. do not count toward the substantial presence test for tax residency. Many individuals must file Form 8843 even if they earned no U.S. income and are not required to file a tax return.
Before mailing, you must accurately complete the most current version of Form 8843, available on the IRS website. You will need several pieces of information, including your full name as it appears on your passport, your current U.S. address, and your address in your country of residence.
You must also provide details about your visa, including its type, the date you entered the U.S., and your current nonimmigrant status if it has changed. The form requires you to list the number of days you were physically present in the U.S. for the current and previous years; travel history can be obtained from the U.S. Customs and Border Protection I-94 website. You must sign and date the form on the second page.
The deadline for submitting Form 8843 depends on whether you are also filing a U.S. income tax return. If you are not required to file a tax return because you had no U.S. source income, your completed Form 8843 must be mailed by June 16, 2025. Each individual, including dependents, must mail their own Form 8843 in a separate envelope to this address: Department of the Treasury, Internal Revenue Service Center, Austin, TX 73301-0215.
If you earned U.S. source income and are required to file a tax return like Form 1040-NR, the deadline is April 15, 2025. You should not mail Form 8843 separately. Instead, you must attach the completed form to the back of your tax return and mail the package to the address specified in the instructions for that return. For proof of submission, it is advisable to use a mailing service with tracking, as the IRS does not send a receipt for Form 8843.
