Identifying Overtime Hours and the Workweek

Identifying overtime hours begins with understanding the “workweek.” The FLSA defines a workweek as a fixed, regularly recurring period of 168 hours, consisting of seven consecutive 24-hour periods. This workweek does not have to align with the calendar week or the pay period. Once established, it generally remains consistent.

Overtime hours are those worked in excess of 40 hours within a single workweek. It is crucial to calculate overtime based on the workweek, not the pay period, especially for semi-monthly payrolls that can span multiple workweeks. Employers must track all time an employee spends working, including tasks performed outside regular shifts, to ensure all hours are accounted for. Accurate record-keeping is vital for precise overtime calculation.

Determining the Regular Rate of Pay

The “regular rate of pay” is the foundation for calculating overtime compensation and often involves more than an employee’s base hourly wage or salary. This rate generally includes almost all forms of compensation paid for employment. It is determined by dividing the total compensation an employee receives in a workweek (with certain statutory exclusions) by the total hours actually worked in that week.

For semi-monthly salaried employees, converting their salary into an hourly regular rate requires a specific calculation. First, multiply the semi-monthly salary by 24 to find the annual salary. Then, divide this annual salary by 52 weeks to get the weekly salary. Finally, divide the weekly salary by the standard number of hours typically worked per week, such as 40 hours, to arrive at the hourly regular rate. For example, a semi-monthly salary of $2,500 equates to an annual salary of $60,000 ($2,500 x 24), a weekly salary of approximately $1,153.85 ($60,000 / 52), and an hourly regular rate of about $28.85 ($1,153.85 / 40).

Various types of compensation must be included when determining the regular rate. These include non-discretionary bonuses, which are promised or expected payments, commissions, and shift differentials paid for working specific hours. Payments for on-call time and production bonuses also factor into the regular rate. The regular rate may not fall below the federal minimum wage or any applicable higher state or local minimum wage.

Conversely, certain payments can be excluded from the regular rate calculation. These include true discretionary bonuses, where the decision to pay and the amount are entirely at the employer’s discretion. Reimbursements for business expenses, bona fide gifts, and payments for time not worked, such as vacation, holiday, or sick pay, are also excludable. These exclusions are permissible because they are not considered compensation for hours worked.

Calculating the Overtime Premium

After determining the regular rate of pay and total overtime hours for a workweek, calculate the overtime premium. Federal law requires overtime pay to be at least 1.5 times the employee’s regular rate for all hours worked over 40 in a workweek, commonly known as “time and a half.”

The overtime premium calculation focuses on the “half” portion because employees have already received straight time (1x) for all hours worked, including overtime. Therefore, the additional payment due for overtime hours is 0.5 times the regular rate. The formula for this additional overtime premium is: (Regular Rate of Pay) x (0.5) x (Number of Overtime Hours). This calculation provides the extra amount owed beyond the straight time already paid.

For example, if an employee’s regular rate is $20 per hour and they worked 10 overtime hours in a workweek, the overtime premium would be calculated as $20 x 0.5 x 10 = $100. This $100 is the additional amount added to their regular earnings for that workweek to fully compensate them for their overtime work. This method ensures the employee receives the full time-and-a-half rate for overtime without double-counting the straight-time portion.

Putting It All Together for Semi-Monthly Payroll

Calculating overtime for employees on a semi-monthly payroll requires attention to how workweeks align with pay periods. A semi-monthly pay period typically results in two paydays per month, which may not consistently align with the start and end of workweeks. The crucial step is to identify all workweeks that fall entirely or partially within the semi-monthly pay period.

Track the hours worked within each specific workweek that touches the current pay period. For instance, if a workweek spans from a Monday in one semi-monthly period to a Sunday in the next, the overtime calculation for that workweek must be completed. The resulting overtime pay might be allocated to a subsequent semi-monthly pay period if the workweek ends after the current pay period’s cutoff.

The regular rate of pay for the employee is then calculated for each workweek. If the employee’s compensation varies due to commissions or non-discretionary bonuses earned during a workweek, this additional compensation must be factored into the regular rate for that specific week. Once the regular rate for a workweek is determined and the overtime hours for that same workweek are identified, the overtime premium is calculated using the established formula. This process is repeated for every workweek that falls into the semi-monthly pay period.

Finally, sum up the total regular pay and the total overtime premium pay for all relevant workweeks to determine the employee’s gross earnings for the semi-monthly period. Meticulous record-keeping of daily and weekly hours worked, along with all forms of compensation, is essential. This detailed tracking allows employers to accurately assign hours and compensation to the correct workweeks, ensuring compliance with federal overtime requirements, even when workweeks overlap semi-monthly pay periods.
